Nejde toti\u017e jen o jednoduch\u00e9 \u010d\u00edslo, kter\u00e9 by provozovatel sv\u00e9voln\u011b stanovil \u2013 za ka\u017ed\u00fdm takov\u00fdm limitem stoj\u00ed kombinace regulatorn\u00edch po\u017eadavk\u016f, intern\u00edch rizikov\u00fdch model\u016f a obchodn\u00edch rozhodnut\u00ed konkr\u00e9tn\u00ed s\u00e1zkov\u00e9 kancel\u00e1\u0159e. Situaci d\u00e1le komplikuje skute\u010dnost, \u017ee \u010desk\u00e1 legislativa v oblasti hazardn\u00edch her pro\u0161la v posledn\u00edm desetilet\u00ed v\u00fdrazn\u00fdmi zm\u011bnami, p\u0159i\u010dem\u017e z\u00e1kon \u010d. 186\/2016 Sb. o hazardn\u00edch hr\u00e1ch p\u0159edstavoval z\u00e1sadn\u00ed p\u0159elom, jen\u017e p\u0159inesl zcela nov\u00fd r\u00e1mec pro licencov\u00e1n\u00ed i provozov\u00e1n\u00ed s\u00e1zkov\u00fdch aktivit na \u00fazem\u00ed \u010cesk\u00e9 republiky. Pochopit, jak tyto limity funguj\u00ed, pro\u010d se li\u0161\u00ed mezi jednotliv\u00fdmi oper\u00e1tory a jak\u00e9 maj\u00ed praktick\u00e9 dopady na hr\u00e1\u010de, vy\u017eaduje hlub\u0161\u00ed pohled do struktury cel\u00e9ho odv\u011btv\u00ed.<\/p>\n<h2>Pr\u00e1vn\u00ed z\u00e1klad a regulatorn\u00ed r\u00e1mec denn\u00edch limit\u016f v \u010cesk\u00e9 republice<\/h2>\n<p>Z\u00e1kon \u010d. 186\/2016 Sb., kter\u00fd vstoupil v platnost 1. ledna 2017, z\u00e1sadn\u011b prom\u011bnil \u010deskou s\u00e1zkovou sc\u00e9nu. P\u0159ed jeho p\u0159ijet\u00edm existoval rozt\u0159\u00ed\u0161t\u011bn\u00fd syst\u00e9m regulace, v n\u011bm\u017e r\u016fzn\u00e9 typy hazardn\u00edch her spadaly pod odli\u0161n\u00e9 pr\u00e1vn\u00ed normy a dohled byl rozd\u011blen mezi st\u00e1t, kraje i obce. Nov\u00e1 legislativa soust\u0159edila dohled p\u0159edev\u0161\u00edm do rukou Ministerstva financ\u00ed a Celn\u00ed spr\u00e1vy \u010cesk\u00e9 republiky, kter\u00e1 od t\u00e9 doby prov\u00e1d\u00ed kontrolu dodr\u017eov\u00e1n\u00ed podm\u00ednek ud\u011blen\u00fdch licenc\u00ed.<\/p>\n<p>Pokud jde konkr\u00e9tn\u011b o denn\u00ed limity v\u00fdher, z\u00e1kon s\u00e1m o sob\u011b nestanov\u00ed pevnou maxim\u00e1ln\u00ed \u010d\u00e1stku, kterou by hr\u00e1\u010d mohl za den vyhr\u00e1t. Regulace se sp\u00ed\u0161e zam\u011b\u0159uje na povinnosti provozovatel\u016f v oblasti odpov\u011bdn\u00e9ho hran\u00ed, identifikace hr\u00e1\u010d\u016f a sledov\u00e1n\u00ed jejich hern\u00edho chov\u00e1n\u00ed. Ka\u017ed\u00fd licencovan\u00fd oper\u00e1tor je povinen v\u00e9st evidenci hr\u00e1\u010d\u016f prost\u0159ednictv\u00edm tzv. hr\u00e1\u010dsk\u00e9ho \u00fa\u010dtu, p\u0159i\u010dem\u017e syst\u00e9m mus\u00ed umo\u017e\u0148ovat nastaven\u00ed limit\u016f vklad\u016f, proher i hern\u00ed doby. Limity v\u00fdher jsou pak do zna\u010dn\u00e9 m\u00edry v\u00fdsledkem intern\u00ed politiky ka\u017ed\u00e9 s\u00e1zkov\u00e9 kancel\u00e1\u0159e, kter\u00e1 vych\u00e1z\u00ed z jej\u00edho obchodn\u00edho modelu a z podm\u00ednek pojistn\u00e9ho kryt\u00ed, je\u017e m\u00e1 uzav\u0159eno.<\/p>\n<p>D\u016fle\u017eitou roli hraj\u00ed tak\u00e9 podm\u00ednky stanoven\u00e9 Regula\u010dn\u00edm org\u00e1nem p\u0159i ud\u011blov\u00e1n\u00ed licence. Oper\u00e1to\u0159i mus\u00ed prok\u00e1zat dostate\u010dnou finan\u010dn\u00ed zp\u016fsobilost k v\u00fdplat\u011b v\u00fdher, co\u017e v praxi znamen\u00e1, \u017ee jejich intern\u00ed limity musej\u00ed b\u00fdt konzistentn\u00ed s kapit\u00e1lovou p\u0159im\u011b\u0159enost\u00ed firmy. \u010cesk\u00e1 n\u00e1rodn\u00ed banka sice s\u00e1zkov\u00e9 kancel\u00e1\u0159e p\u0159\u00edmo nedohl\u00ed\u017e\u00ed, ale finan\u010dn\u00ed stabilita provozovatel\u016f je sou\u010d\u00e1st\u00ed licen\u010dn\u00edho \u0159\u00edzen\u00ed. V\u00fdsledkem je, \u017ee limity v\u00fdher nejsou n\u00e1hodn\u00e9 \u2013 odr\u00e1\u017eej\u00ed re\u00e1lnou schopnost oper\u00e1tora dost\u00e1t sv\u00fdm z\u00e1vazk\u016fm v\u016f\u010di hr\u00e1\u010d\u016fm.<\/p>\n<p>Specifick\u00e1 situace nast\u00e1v\u00e1 u kurzov\u00e9ho s\u00e1zen\u00ed, kde v\u00fd\u0161e potenci\u00e1ln\u00ed v\u00fdhry z\u00e1vis\u00ed na kombinaci vlo\u017een\u00e9ho obnosu a nab\u00eddnut\u00e9ho kurzu. S\u00e1zkov\u00e9 kancel\u00e1\u0159e proto pracuj\u00ed s tzv. maxim\u00e1ln\u00ed v\u00fdplatou na tiket, kter\u00e1 je zpravidla uv\u00e1d\u011bna ve v\u0161eobecn\u00fdch obchodn\u00edch podm\u00ednk\u00e1ch. Tato maxim\u00e1ln\u00ed v\u00fdplata b\u00fdv\u00e1 v \u010desk\u00e9m prost\u0159ed\u00ed stanovena v rozmez\u00ed od p\u0159ibli\u017en\u011b 500 000 K\u010d a\u017e po n\u011bkolik milion\u016f korun v z\u00e1vislosti na oper\u00e1torovi a typu s\u00e1zkov\u00e9 ud\u00e1losti. Odli\u0161n\u00e1 pravidla plat\u00ed pro kombinovan\u00e9 tikety a pro s\u00e1zky na \u017eiv\u00e9 ud\u00e1losti, kde jsou limity tradi\u010dn\u011b p\u0159\u00edsn\u011bj\u0161\u00ed kv\u016fli vy\u0161\u0161\u00ed volatilit\u011b v\u00fdsledk\u016f.<\/p>\n<h2>Jak Sazkovyradce analyzuje a porovn\u00e1v\u00e1 limity jednotliv\u00fdch oper\u00e1tor\u016f<\/h2>\n<p>Orientace v podm\u00ednk\u00e1ch r\u016fzn\u00fdch s\u00e1zkov\u00fdch kancel\u00e1\u0159\u00ed je pro b\u011b\u017en\u00e9ho hr\u00e1\u010de obt\u00ed\u017en\u00e1, proto\u017ee ka\u017ed\u00fd oper\u00e1tor prezentuje sv\u00e1 pravidla jin\u00fdm zp\u016fsobem a v r\u016fzn\u00e9 m\u00ed\u0159e podrobnosti. P\u0159edstavte si situaci, kdy hr\u00e1\u010d vsad\u00ed 5 000 K\u010d na kombinovan\u00fd tiket s celkov\u00fdm kurzem 150, tedy s potenci\u00e1ln\u00ed v\u00fdhrou 750 000 K\u010d. Pokud m\u00e1 jeho s\u00e1zkov\u00e1 kancel\u00e1\u0159 nastaven denn\u00ed limit v\u00fdplat na 500 000 K\u010d, dostane se hr\u00e1\u010d do situace, kterou p\u0159edem ne\u010dekal a na ni\u017e nebyl p\u0159ipraven.<\/p>\n<p>Oper\u00e1to\u0159i jsou povinni hr\u00e1\u010de na existenci limit\u016f upozornit, ov\u0161em zp\u016fsob a prominentnost tohoto upozorn\u011bn\u00ed se li\u0161\u00ed. \u010cesk\u00e1 obchodn\u00ed inspekce a Celn\u00ed spr\u00e1va opakovan\u011b \u0159e\u0161ily st\u00ed\u017enosti hr\u00e1\u010d\u016f, kte\u0159\u00ed se o existenci limitu dozv\u011bd\u011bli a\u017e v okam\u017eiku v\u00fdplaty. Modern\u00ed s\u00e1zkov\u00e9 platformy by m\u011bly hr\u00e1\u010de upozornit je\u0161t\u011b p\u0159ed potvrzen\u00edm tiketu, pokud by jeho potenci\u00e1ln\u00ed v\u00fdhra p\u0159es\u00e1hla nastaven\u00fd limit. Fotbalov\u00e9 ligy prvn\u00ed kategorie \u2013 Premier League, Bundesliga, La Liga \u2013 maj\u00ed zpravidla vy\u0161\u0161\u00ed limity ne\u017e m\u00e9n\u011b sledovan\u00e9 sout\u011b\u017ee, proto\u017ee oper\u00e1to\u0159i maj\u00ed pro tyto trhy lep\u0161\u00ed p\u0159\u00edstup k informac\u00edm a mohou p\u0159esn\u011bji modelovat riziko. Hr\u00e1\u010d, kter\u00fd si zvol\u00ed neobvykl\u00fd s\u00e1zkov\u00fd trh, by si m\u011bl v\u017edy ov\u011b\u0159it, zda pro danou kategorii plat\u00ed standardn\u00ed nebo sn\u00ed\u017een\u00fd limit.<\/p>\n<h2>V\u00fdvoj limit\u016f v kontextu odpov\u011bdn\u00e9ho hran\u00ed a budouc\u00edch regula\u010dn\u00edch zm\u011bn<\/h2>\n<p>Diskuse o denn\u00edch limitech v\u00fdher nelze odd\u011blit od \u0161ir\u0161\u00edho kontextu odpov\u011bdn\u00e9ho hran\u00ed, kter\u00fd se v posledn\u00edch letech stal kl\u00ed\u010dov\u00fdm t\u00e9matem regulace hazardn\u00edch her v cel\u00e9 Evropsk\u00e9 unii. \u010cesk\u00e1 republika v tomto ohledu postupuje v souladu s evropsk\u00fdmi trendy \u2013 z\u00e1kon o hazardn\u00edch hr\u00e1ch byl od sv\u00e9ho p\u0159ijet\u00ed v roce 2016 n\u011bkolikr\u00e1t novelizov\u00e1n, p\u0159i\u010dem\u017e ka\u017ed\u00e1 novela zp\u0159\u00eds\u0148ovala po\u017eadavky na ochranu hr\u00e1\u010d\u016f. Ministerstvo financ\u00ed vydalo v roce 2020 vyhl\u00e1\u0161ku, kter\u00e1 up\u0159esnila technick\u00e9 parametry hr\u00e1\u010dsk\u00fdch syst\u00e9m\u016f, v\u010detn\u011b povinnosti umo\u017enit hr\u00e1\u010d\u016fm nastavit vlastn\u00ed limity vklad\u016f a proher.<\/p>\n<p>Vlastn\u00ed limity nastaven\u00e9 hr\u00e1\u010dem jsou p\u0159itom odli\u0161n\u00e9 od limit\u016f stanoven\u00fdch oper\u00e1torem \u2013 jde o n\u00e1stroj odpov\u011bdn\u00e9ho hran\u00ed, kter\u00fd hr\u00e1\u010di umo\u017e\u0148uje regulovat sv\u00e9 v\u00fddaje.
